This document (hereinafter referred to as “This Document” or “Terms and Conditions”) represents the conditions for using the Lockerly.eu website (hereinafter referred to as the “Website”). Lockerly website and the services offered through it are not intended for minors. If you are under 18 years of age, you are not allowed to use the Services without the permission of a parent/guardian.
The information provided on the site is not intended for distribution or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to laws or regulations or where it would subject us to any registration requirements within that jurisdiction or country.
Website Usage Rules
By accessing, visiting, or conducting any other activity on our website, you agree to comply with the applicable laws and the following rules:

- You will provide real, accurate, complete, and updated information;

Definitions and Terms
In this document, the following terms shall have the meanings specified below, unless a different meaning is implied by the particular context in which they are used:
- Contractor: Smart ID Dynamics SA, referred to in this document and throughout the Website under the trade name Lockerly.
- User: An individual who is at least 18 years old or a representative of a legal entity that visits and/or interacts with the Website.
- Beneficiary/Client: An individual who is at least 18 years old or a representative of a legal entity that orders hardware equipment as a result of submitting a request through the website (chat form) or subsequently, through telephone or email, or who requests consultancy regarding software and automation solutions, as a result of signing a physical Contract.
- Site: The entire presentation content hosted at Lockerly.eu, along with all related subdomains, regardless of its format (text, image, audio, video).
Content
- All information available on the Site that can be visited, viewed, or accessed by any means, using electronic equipment for this purpose;
- The content of any message sent and any information communicated to Users and/or Beneficiaries by Smart ID Dynamics through electronic means and/or any other available means of communication;
- Information related to Goods and/or Services and/or prices charged by Smart ID;
- Data related to Smart ID or other privileged data thereof.
Goods and Services
Any product or service presented on the Site, including products and services to be provided to the Beneficiary by Smart ID as a result of ordering equipment and/or accessories or entering into a physical contract for the execution of a project for implementing a software/automation solution that may or may not include the acquisition of hardware.
Contract
Refers to the execution contract for implementing a solution, concluded in physical format between Smart ID and the Beneficiary, with the simultaneous physical presence of the Contractor and the Beneficiary.
Transactional message
A message sent to request clarifications necessary for preparing the execution project and the customized offer requested by the User and the execution contract or punctual communication transmitted electronically to the Beneficiary that may contain information about the Order, a satisfaction questionnaire following the completion of a project, etc.
Transactional messages and communication
By sending a message requesting information and/or a request for a quote to the contact details or by completing the contact form on the Site or through the online chat application on the Site or by contracting an execution project, the User/Beneficiary understands that they will receive transactional messages, including communications regarding orders or execution projects that have not yet been contracted, using the contact details provided by the User/Beneficiary, and agrees to the form of communication through which Smart ID conducts its business operations (telephone, email) and consents to receive these transactional messages.
Messages received by the Beneficiary after submitting a request for a quote are for informational purposes only and do not represent confirmation of the Order being accepted. The order for hardware and/or accessory equipment is considered accepted upon the telephone/email acceptance of the transmitted offer or upon signing the execution contract for a project, a document concluded between the Contractor and the Beneficiary. The order may be modified or canceled strictly under the conditions agreed upon in the contract.
The Romanian language is the language of communication between Smart ID and the User or Beneficiary, as well as the language for drafting Content and any documents, procedures, transactions, etc., governed by these Terms and Conditions.
Transmission of information
Users of the site may submit requests for information, requests for quotes, suggestions, ideas, questions, or other information, may make comments, and any other communications as long as their content is not illegal, obscene, threatening, defamatory, does not disturb the private life of others in any way, does not infringe intellectual property rights, does not contain viruses, texts related to various promotional campaigns, chain letters, bulk emails, or any other form of spam. Individuals who use a false email address or send electronic messages or any other communications on behalf of another individual or legal entity or on behalf of any other entity will be penalized in accordance with applicable laws.
Personal data
Communication with Lockerly/Smart ID can be done through direct interaction, via the phone or email mentioned in the contact section of the Site.
The personal data of the User, regardless of the channel through which it was received, may only be used by Smart ID for the declared purpose of this Site, including but not limited to the exchange of information necessary for preparing the project, the personalized offer, and the execution contract, delivery and installation status of products, notifications about potential promotions, etc. For more details, please consult the sections on Smart ID’s Personal Data Processing Policy and Cookie Policy, which are displayed on the website as an integral part of the material related to GDPR.
Intellectual property rights
The content, including but not limited to logos, stylized graphic representations, trademarks and symbols, static images, dynamic images, text, web graphics elements, and/or multimedia content presented on the Site, represents the exclusive property of Smart ID, which reserves all rights obtained directly or indirectly (through publication and/or usage licenses) over it and is protected by copyright law and intellectual property laws. The combination of these elements (the design of the Site) is the exclusive property of Smart ID and is protected by copyright law and intellectual property laws.
It is prohibited to copy, distribute, publish, transfer to third parties, modify and/or alter, use, link to, expose, include any Content in any context other than the original, include any Content outside the Site, remove trademarks signifying Smart ID’s copyright over the Content, as well as participate in the transfer, sale, distribution of materials made by reproducing, modifying, or displaying Content, except with the express written consent of Smart ID.
The User or Beneficiary may copy, transfer, and/or use Content only for personal or non-commercial purposes and only if such use does not conflict with the provisions of these terms and conditions.
Limitation of liability
Smart ID reserves the right to unilaterally modify these terms and conditions, the content, the presentation format, and/or the structure of the website at any time. Changes take effect as soon as they are accessible and are deemed accepted by you if you continue to use the website after their display.
The information used to describe the Goods and/or Services presented on the Site (text, static or dynamic images, video, etc.) does not constitute a contractual obligation on the part of Smart ID, being used exclusively for presentation purposes. Smart ID makes constant efforts to provide accurate and correct information on the pages of Goods and/or Services presented on the Site; however, there may be instances where this information contains inaccuracies: human operational errors, informative photographs that may show specifications or accessories not included in standard configurations, etc.
For justified reasons, Smart ID reserves the right to refuse collaboration with certain clients if it considers, based on their history, that their actions could harm Smart ID in any way.
Smart ID cannot be held liable for any damages of any kind that the User, Beneficiary, or any third party may suffer as a result of using the Site.
Fraud
Any attempt to access the personal data of another user, modify the content of the Site, or affect the performance of the server on which the Lockery.eu site operates will be
considered an attempt to defraud the Lockerly.eu website and will result in the initiation of criminal proceedings against the individual(s) who attempted this act.
Applicable law. Disputes
By visiting the Site, the User agrees that Romanian laws will govern these terms and conditions, as well as any dispute of any kind that may arise between the User and Smart ID or its partners. In the event of conflicts between Smart ID and its clients, an amicable resolution will be attempted first. If amicable resolution is not possible, the conflict will be resolved in the competent court in the Municipality of Bucharest, in accordance with the applicable Romanian laws.
